California Passport Policies, Terms and Conditions

Cancellation Policy

Clients must inform California Passport (the “Company”) via email if there is a cancellation within 72 hours from departure time.  California Passport reserves the right to cancel any service without refund, if the operator or the office feels that the client/party of the client is putting the operator or the mode of transportation or the client/party of the client in danger. Or if the client/party of the client is in possession of any illegal material or substance, this service will be canceled without refund. A reschedule is considered cancellation.

 

No Show Policy

A no-show policy fee equal to 100% of the trip cost will be charged when the passenger fails to show at the designated location or cancels within 72 hours of departure time. 

 

Vehicle damage and Cleaning

California Passport is not responsible for damage to the equipment, or injuries caused to passengers or other third persons caused by any passenger or baggage, parcels or other property brought on board or transported on the equipment by any passenger. The cost of repairing damage to equipment resulting from acts of any passenger shall be charged to the chartering party and is to be paid as soon as such cost is determined.

If during or after the transportation service, California Passport is required to apply a greater than normal amount of time and materials to clean the equipment properly due to acts of the passengers, we will require additional cost to cover such additional time and materials. Vomit cleanup starts at $350. California Passport shall be entitled to reimbursement of any cost of collections.

 

Baggage and other property transported

California Passport, assumes no responsibility whatsoever for the handling or maintenance of any baggage, parcels or other property. Baggage and all other personal property will be handled only at passenger’s own risk. Passengers’ baggage shall be carried subject to the available accommodations (as determined solely by the service provider) provided by interior and/or exterior racks.

 

Passenger Conduct

All vehicles are non smoking vehicles. Passengers shall not interfere with the Driver in the performance of his/her duty or tamper with any apparatus or appliance in the vehicle in a harmful manner. Driver may not be distracted while driving, for the safety of all passengers.

 

Conditions outside our control. 

Road, traffic and weather conditions are beyond the control of the company and the service provider, and no refunds shall be given as a result of late arrivals due to such conditions or other occurrences out of the control of the company or the service provider.  California Passport will take commercially reasonable steps to mitigate the risks of road, traffic, and weather conditions affecting or delaying the provision of services hereunder.  

In case of trip delays and interruption due to a mechanical problem with the vehicle (e.g. flat tire) the whole cost of trip will be refunded. In addition we will provide clients the means to reach a public transportation point that allows for return to the original departure point.

 

Disputes. If there is any dispute about or involving  the Company’s Website, services or equipment, you agree that the dispute will be governed by the laws or the State of California without regard to its conflict of law provisions. You agree to personal jurisdiction by and venue in the state and federal courts of the State of California, County of Santa Clara.

Indemnity. You agree to indemnify and hold California Passport, its subsidiaries, affiliates, officers, agents and other partners and employees, harmless from any loss, liability, claim or demand, any personal injury or physical damage to himself,  including reasonable attorney's fees (collectively, “Indemnified Losses”), made by any third party due to or arising out of your use of the Company’s Website, services and equipment, except to the extent such Indemnified Losses are caused by the negligence or willful misconduct of California Passport, its employees, agents, and/or contractors.

 

DISCLAIMER CALIFORNIA PASSPORT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. CALIFORNIA PASSPORT WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF  COMPANY’S WEBSITE,SERVICES AND EQUIPEMENT INCLUDING WITHOUT, LIMITATION DIRECT, INDIRECT, INCIDENTAL, PUNITIVE AND CONSEQUENTIAL DAMAGES, EXCEPT TO THE EXTENT SUCH DAMAGES ARISE FROM THE NEGLIGENCE OR WILLFUL MISCONDUCT OF CALIFORNIA PASSPORT, ITS EMPLOYEES, AGENTS, AND/OR CONTRACTORS.
